Touchpoint Engine ("we," "us," "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, create an account, or subscribe to our newsletter services (collectively, the "Services").
By using the Services, you consent to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.
(a) Information you provide directly, such as:
your name, business name, email address, mailing address, and phone number when you register or subscribe;
billing and payment information (processed by our third-party payment processor — see Section 4);
your brand assets (logo, headshot, biography, listing information) used to personalize your newsletter; and
your client and prospect contact database (names and mailing addresses) that you upload for the purpose of having your newsletter mailed to them ("Contact Data").
(b) Information collected automatically, such as your IP address, browser type, device information, pages visited, and referring URLs, collected through cookies and similar technologies. See our www.touchpointengine.com/privacy/ for details.
(c) Information from third parties, such as information received from payment processors or, where applicable, a connected customer relationship management (CRM) or contact-database tool.
We use the information we collect to:
create and manage your account and subscription;
design, produce, print, and mail your personalized newsletters to the Contact Data you provide;
process payments and manage billing;
send you proofs, service notices, and administrative communications;
respond to your inquiries and provide customer support;
improve and maintain the Platform; and
comply with legal obligations and enforce our agreements.
We do not use your Contact Data for any purpose other than fulfilling your newsletter mailings, unless you separately authorize additional use.
Where required by applicable law, we process personal information on the basis of: performance of a contract with you (to deliver the Services you subscribed to), your consent, our legitimate business interests (such as maintaining and improving the Services), and compliance with legal obligations.
We do not sell your personal information or your Contact Data. We may share information with:
Service providers who perform functions on our behalf, such as printers and mail houses (to produce and deliver your newsletter), payment processors, hosting providers, and customer database/CRM providers. These providers are contractually restricted from using your information for any purpose other than providing services to us.
Legal and safety purposes, where required to comply with law, respond to legal process, or protect the rights, property, or safety of Touchpoint Engine, our users, or others.
Business transfers, such as a merger, acquisition, or sale of assets, subject to standard confidentiality arrangements.
We store account information and Contact Data using industry-standard administrative, technical, and physical safeguards designed to protect it from unauthorized access, loss, or misuse. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Because you (not Touchpoint Engine) create and maintain your Contact Data, you are responsible for ensuring the accuracy and completeness of the contact information you upload, and for confirming that you have the right to have that information used for mailing purposes.
We retain personal information and Contact Data for as long as your account or subscription remains active, and for a reasonable period afterward as needed to comply with legal, accounting, or reporting obligations, resolve disputes, or enforce our agreements. You may request deletion of your Contact Data as described in Section 7.
Depending on your location, you may have rights to:
access, correct, or request deletion of your personal information;
withdraw consent to certain processing;
object to or restrict certain uses of your information; and
request a copy of your information in a portable format.
To exercise any of these rights, contact us using the details in Section 11. We will respond within the timeframe required by applicable law.
